Terms and Conditions of Sale – Vivariom

 

1. Purpose

These Terms and Conditions of Sale (“T&Cs”) govern sales made on the www.vivariom.com website between Vivariom (“the Seller”) and any individual or legal entity making a purchase (“the Customer”).
By confirming an order, the Customer fully and unconditionally accepts these T&Cs.

2. Products

The posters sold on www.vivariom.com are printed on demand according to the specifications chosen by the Customer (size, artwork, finish). Images and descriptions on the website are for illustrative purposes only; minor variations in color or cropping may occur due to the printing process.

3. Prices

Prices are shown in euros, inclusive of all taxes (TTC). Shipping costs are indicated during checkout and added to the total amount.
The Seller reserves the right to change prices at any time, but products will be invoiced based on the rates in effect at the time the order is confirmed.

4. Orders and Payment

An order is considered confirmed once payment has been validated using the payment methods offered on the site.
The Seller reserves the right to refuse any order from a Customer with whom there is an unresolved payment dispute.

5. Production and Delivery

Posters are produced on demand by our printing partner.
Delivery times may vary depending on the destination; an estimate is provided during checkout. The Seller is not responsible for delays caused by the carrier.

6. Withdrawal and Returns

6.1 Custom-made products

In accordance with Article L221-28 of the French Consumer Code and EU Directive 2011/83/EU, the 14-day right of withdrawal does not apply to goods made to the Customer’s specifications or clearly personalized, such as our print-on-demand posters.

6.2 No returns for change of mind

No returns or exchanges are accepted in cases of change of mind, incorrect size selection, or Customer ordering errors.

6.3 Defective or damaged products

If the product is defective, has a manufacturing error, or arrives damaged, the Customer must contact the Seller within 30 days of receipt at contact@vivariom.com, providing:

  • The order number.

  • Photos of the defect and packaging.

  • A photo of the shipping label.

Once validated, the Seller will either send a replacement at no additional cost or issue a full refund.

6.4 Exclusions

No refund will be granted for:

  • Color or print variations inherent to the printing process.

  • Damage caused by mishandling after delivery.

  • Claims made after the 30-day period.

7. Refunds

Approved refunds are processed to the original payment method within 10 business days. Bank processing times may vary.

8. Intellectual Property

All visuals, designs, and content on the site are protected by copyright law. Any reproduction or use without prior written authorization is prohibited.

9. Liability

The Seller cannot be held liable for damages resulting from misuse of the product or from causes beyond its control related to production and delivery.

10. Governing Law and Disputes

These T&Cs are subject to French law. In the event of a dispute and failing an amicable resolution, French courts shall have sole jurisdiction.
